Captain Cook Cruises:

All cancellations are subject to an AUD$50.00 administration fee per person. Cancellation requests must be made in writing, and we strongly suggest the use of registered mail or fax. Cancellations received inside 60 days of sailing will be subject to cancellation charges at the following rates: 30-59 days; AUD$200.00 pp deposit. within 15-29 days; 50% of fare. 14 days or less; 100% of fare. no-shows at sailing; 100% of fare. Cancellation fees, less the administration fee may be applied to another cruise if completed within 12 months of original booking.

Sailaway:

Full refund only applies with 24 hours notice of date adjustment or cancellation.

Sydney HeliTours:

Cancellation 24-48 hours before the flight incurs a 50% cancellation fee. If cancelled within 24 hrs of the flight, there is a 100% cancellation fee. If passengers elect not to fly due to weather, but the helicopter flight is still operational, a 100% cancellation fee applies.

Flames of the Forest:

For bookings up to 5 passengers - Cancellation fee of 100% applies within 24 hours of the event. For bookings of 6 or more passengers - Cancellation fee of 100% applies within 7 days of the event.

Exemplar Coaches & Limousines:

No penalty outside 24 hours. 100% within 24 hours.

Gray Line Sightseeing Day Tours - Melbourne & Adelaide:

Cancellation fees of 50% may apply for a tour cancelled within 72 and 24 hours of travel. Cancellation fees of 100% may apply to cancellations within 24hrs of travel or when no notice is given. Cancellation fees imposed on Gray Line by our suppliers will also be passed on. Tours may be cancelled at Gray Line's discretion in the event of unforeseen circumstances.

SA Eco Tours :

TOUR TRIP AND ASSUMPTION OF RISK: Australian Private Tours & Charters also T/A SA ECO TOURS operates tours in regions where standards of accommodation, transport, safety, hygiene, medical facilities, and other infrastructure may, at times, not be of the standard that you are used to at home. By booking with Australian Private Tours & Charters you acknowledge that participation in all trips involves inherent risks that may not be present in the case of conventional or less demanding holidays. These risks include, without limitation, the possibility of injury or death, psychological trauma, disease, loss or damage to property, inconvenience, and discomfort. The possibility of experiencing all or some of these risks is likely to be higher if participating in any of our tours that involves visiting remote or unstable regions, or regions where there is dangerous wildlife. CANCELLATION BY YOU: If you wish to cancel all or any part of your booking, notification of cancellation must be received by Australian Private Tours & Charters via email. The date of the cancellation is the date on which Australian Private Tours & Charters receives this notification. Charges applicable as follows, per person: If cancelled more than 30 days before departure and money has already been paid to Australian Private Tours & Charters, passengers will receive a full refund minus any processing or bank charges. If cancelled 30 days or less before departure, there will be no refund given. For any booking for which an initial deposit (part payment) was payable, payment of the remainder of the tour cost must be made at least 31 days prior to the departure of your tour. If you do not pay the balance of your total booking cost within this time frame, your booking may be terminated and you may lose your deposit. Additional Australian Private Tours & Charters cancellation penalties may apply. No refunds will be made if you leave a trip for any reason after the trip has begun. No refunds will be made for any accommodation, transport, sightseeing, meals, or services not utilised. CANCELLATION BY AUSTRALIAN PRIVATE TOURS & CHARTERS: Australian Private Tours & Charters reserves the right to cancel a departure and will advise you of such cancellations as soon as possible. If due to “Force Majeure” or government travel advice, Australian Private Tours & Charters reserves the right to cancel a departure at any time. With any form of cancellation, Australian Private Tours & Charters will do their best to offer you alternative arrangements. If the price of your alternative booking is of a lower value than the original booking, we will refund the difference to you (in case of “Force Majeure” or government travel advice refunds will be less any unrecoverable costs). Australian Private Tours & Charters will not be liable for any additional costs incurred by you. COVID VACCINATIONS: Any passenger travelling with Australian Private Tours & Charters also T/A SA ECO TOURS must have been fully vaccinated against covid. Proof of the vaccination must be emailed to our office at the time of booking. EXCLUSION OF LIABILITY: Except where stated otherwise, Australian Private Tours & Charters acts as an agent for service providers when planning for your trip. Where Australian Private Tours & Charters provides services, it will do so with due care and skill. Australian Private tours & Charters is not responsible for the acts and omissions of others, including tour guides, airlines and accommodation providers for any loss, damage, death, injury, or expense (including loss of money paid in advance), which you may incur as a consequence of the acts and omissions of others. You warrant that you have not relied on any representation made by Australian Private Tours & Charters any travel agent or other representative, which has not been stated expressly in their brochures. FORCE MAJEURE: Australian Private Tours & Charters will not be liable for any delay in, change to or cancellation of trips due to “Force Majeure”. “Force Majeure” means a circumstance beyond the reasonable control of Australian Private Tours & Charters and includes, but is not limited to, war or threat of war, riot, civil strife, terrorist activity, industrial dispute, disease, industrial or nuclear disaster, adverse weather conditions and vehicle breakdown. CHANGES TO YOUR HOLIDAY: You acknowledge that travelling with Australian Private Tours & Charters requires a degree of flexibility, good humour, and an understanding that the itinerary, accommodation, and/or modes of transport may change, even after a tour’s commencement, without prior notice due to local circumstances. Changes may occur because of “Force Majeure”, poor road conditions, weather, the availability of tickets, vehicle breakdowns, changes in transport schedules, or other circumstances beyond Australian Private Tours & Charters control or which simply cannot be foreseen. This includes state lockdowns due to viruses or any other Government regulations. Australian Private Tours & Charters does not accept any responsibility for loss of enjoyment, inability to meet flights or other delays resulting from circumstances beyond Australian Private Tours & Charters’ control. You acknowledge that group sizes may also vary during the duration of the tour. The information about trips given in brochures, Trip notes and Pre departure information are subject to change. TRAVEL INSURANCE: Adequate and valid travel insurance is highly recommended for all passengers travelling with Australian Private Tours & Charters. Your travel insurance should cover accidents, injury, illness, death medical expenses, emergency repatriation (including helicopter rescue and air ambulance and personal liability. Australian Private Tours & Charters also recommends it covers cancellation of tours, curtailments and loss of luggage and personal effects. HEALTH, FITNESS, TRIP GRADES AND AGE LIMITS: It is your responsibility to advise Australian Private Tours & Charters of any pre-existing medical condition and/or disabilities that might reasonably be expected to increase the risk of you requiring medical attention, or that might affect the normal conduct of a tour and the enjoyment of other trip members. Australian Private Tours & Charters reserves the right, at its discretion, to cancel your booking and refund the money paid by you, less any unrecoverable costs, based on this advice or lack of its provision. Australian Private Tours & Charters also reserves the right to cancel your participation in a trip at any time, including after the commencement of your trip, with no right of refund if your medical condition and/or disability could be reasonably expected to affect the normal conduct of the trip and the enjoyments of other trip members. Generally, we do not allow single travellers under the age of 18 years on Australian Private Tours & Charters scheduled itineraries. However, we will occasionally make exceptions for under 18s travelling with their legal guardian. Kotahi Tourism:

KOTAHI TOURISM TERMS & CONDITIONS Kotahi Tourism accepts your booking subject to the following terms and conditions. Please ensure you read carefully and understand these terms prior to confirming your booking. 1. Booking Your booking is confirmed on receipt of payment. All participants must confirm bookings in advance. Kotahi Tourism recommends booking early to avoid disappointment. Prices are per person in Australian dollars. GST is not applicable. Tickets are transferable. Please notify Kotahi Tourism of the new participant. Once the tour has departed no portion of the payment is refundable, no exceptions. Third Party Bookings Booking vouchers must be shown when booking is made through a third party booking agent (“Reseller”). Participants who purchased the tour through a Reseller are subject to the conditions of the booking agent. 2. Cancellation Policy Cancellations will result in the following: More than 30 days notice: Full refund of the Tour Fee Less than 30 days notice and more than 24 hours notice: 50% refund of the Tour Fee Less than 24 hours notice: No refund No refunds are payable to persons booking with a gift voucher. Kotahi Tourism reserves the right to cancel or reschedule the tour in cases of extreme weather or dangerous conditions that are not within the control of the guide or Kotahi Tourism. Tours will still proceed if it is raining. 3. Gift vouchers Gift vouchers are not redeemable for cash and must be used prior to the expiry date. Participants using a gift voucher must ensure they are booked on a tour in order for gift vouchers to be redeemed. 4. Conduct Kotahi Tourism reserve the right to stop any Participants from continuing the tour if they breach our safety standards, or if the participant is behaving in an unacceptable manner or affected by any substance. Any person who is expelled from the Tour on this basis will forfeit the Tour Fee. 5. Safety The tour route includes walking up and down stairs, over uneven ground and crossing busy intersections - "the activities' Due to the nature and extent of the activities, you warrant that: a. You are physically and mentally able to undertake the activities; b. You have no pre-existing condition that may be affected by the activities; and c. You have adequate and appropriate footwear and clothing for the activities. You understand and agree to accept full responsibility for your own safety and wellbeing during the tour. This includes paying due care and attention to traffic, pedestrians and other potential obstacles and dangers. Kotahi Tourism accepts no liability whatsoever for any loss or injury incurred as a result of participation in the tour to the extent permitted by law. In the event that any statute prevents liability being excluded or modified then this clause shall be interpreted as applying only to such liability that can be excluded or modified by agreement between the parties. Kotahi Tourism accepts no liability for any loss or damage to your personal property while on the tour, including but not limited to personal belongings, valuables, photographic equipment or clothing. 6. Indemnity You agree to indemnify Kotahi Tourism from and against any claim by a third party for loss or damage (and the legal costs incurred in defending the same) arising out of your conduct while participating in the Tour, or due to any breach of these Terms and Conditions. Kotahi Tourism is not liable for any loss, damage or inconvenience arising from or incidental to any delay in the scheduled tour taking place. Any loss or damage to third party property is solely your responsibility. 7. Miscellaneous Terms (a) All Participants acknowledge and agree that that Kotahi Tourism is expressly authorised to take photographs of Participants during the tour and utilise such photographs for the purpose of promoting Poihakena Tours including but not limited to being displayed on the Kotahi Tourism website. (b) Photographs remain copyright to the Company and may only be used or reproduced by Participants for private or domestic purposes and must not be used for any commercial purpose, including promotion of any supplier or any supplier's products or services, without the Company’s prior written permission. 8. Governing Law These Terms are governed by the laws of New South Wales, Australia. Kotahi Tourism and each Participant submit to the non-exclusive jurisdiction of the Courts of New South Wales in respect of these Terms and any dispute between them.

Hills Luxury Day Tours:

A full refund is available for cancellation up to 6 days before your tour. Cancellation less than 6 days prior to departure will not be refunded.

HIT THE ROAD TOURS PTY LTD:

No fees if cancelled 24 hours prior departure. No refund after that.
